Seminar on International Business Transactions and U.S Tort Law

The Faculty of Law in coordination with Sanrachna, SGT University organized a Seminar on the topic of “International Business Transactions and U.S Tort Law” in which the distinguished resource persons were from the School of Law, University of Missouri, Kansas City and The Supreme Court of India.

The seminar was attended by the students of the Faculty of Law and Faculty of Commerce and Management along with the faculty members.

The seminar began with the elucidation of the terms Law of Torts and Business Laws.

The resource persons discussed the following points

  • Siddharth Luthra, Senior Advocate, Supreme Court of India, highlighted that in the United States of America the U.S Tort Law is developed and India is still learning from the U.S. However, there are various laws which have been updated. For Example- Environment Laws, Consumer laws and Intellectual Property laws. Indian transborder business relationship is developing and so are the International Business laws. He has emphasised the need to have legislation for the epidemic.
  • University of Missouri, Kansas City discussed a US case law filed by Indian National from Gujarat. With the example of this case which was decided in 2019, he emphasised that International Organisations need immunity to function efficiently.
  • discussed various Intellectual Property Rights. He used the examples of compulsory Licencing for Covid vaccines and discussed the importance of the TRIPS agreement. He further discussed the issues in the pharmaceutical industry. Further, he emphasised the importance of negotiation with the Patent Holder for licencing.
  • (In absentia) his points were discussed by Mr. Rajneesh Wadhwa, Dean, External Affairs, SGT University discussed the common law system adopted by the US. He also discussed various International Agreements of which India is a signatory.
  • discussed the impact of Covid on the Economy and Business Transaction. She explained the importance of Jurisdictional understanding and also stated that nowadays Fraud and Negligence are defined very clearly in contracts.

The event was successfully completed with a vote of thanks given by Prof. (Dr.) Sanjay Kumar Pandey, Dean, Faculty of Law, SGT University followed with high tea.
